Procedure for medical care in health care institutions of the Ministry of Internal Affairs

approved by the Order of the Ministry of Internal Affairs of Ukraine No. 462 dated 03.06.2016

(as amended by the Order of the Ministry of Internal Affairs of Ukraine No. 1051 dated 20.12.2017)

 

1. The right to medical care in healthcare institutions of the Ministry of Internal Affairs is granted to

1) civil servants and employees of the MIA apparatus, territorial bodies providing services of the MIA, institutions, establishments, and enterprises belonging to the sphere of management of the MIA;

2) servicemen of the National Guard of Ukraine (hereinafter referred to as the NGU), persons liable for military service and reservists called up for training or testing and special training, civil servants and employees of the main military command body of the NGU, operational-territorial associations of the NGU, formations, military units (subdivisions), higher military educational institutions, military training units (centers), bases, healthcare institutions, and establishments;

3) police officers, civil servants, and employees of the central management body of the Police, territorial (including interregional) bodies of the Police, research and support institutions, enterprises, institutions, and organizations that belong to the sphere of management of the National Police;

4) civil servants and employees of the apparatus of the State Migration Service of Ukraine (hereinafter - SMS), its territorial bodies and territorial subdivisions, enterprises, institutions, and organizations belonging to the sphere of management of the SMS;

5) police officers, servicemen of the National Guard of Ukraine, and civil servants of the MIA apparatus, who, following the legislation, are seconded (seconded) to the Verkhovna Rada of Ukraine, the Verkhovna Rada of the Autonomous Republic of Crimea, other state authorities (institutions, establishments) or local self-government bodies for the period of performance of their respective powers permanently with remaining in the police, military service, civil service;

6) persons enrolled for full-time education under the state order to a higher education institution with specific conditions of education that belongs to the sphere of management of the Ministry of Internal Affairs - for the period of education.

Police officers enrolled for primary professional training or postgraduate education at the place of deployment of a higher education institution - for the period of study.

Servicemen of the NGU who are enrolled for full-time education under a state order in a higher military educational institution, military training unit (centers) of the NGU - for the period of study;

7) citizens of Ukraine from among:

former police officers, persons holding the rank of private and commander of the internal affairs bodies who were dismissed from service for health reasons, age, due to staff reduction

former police officers dismissed from service in the internal affairs bodies due to age, illness, or seniority;

former police officers who, as of the day of publication of the Law of Ukraine "On the National Police", served in internal affairs bodies and had at least five years of calendar service and continued to work in the Ministry of Internal Affairs of Ukraine or the National Police (their territorial bodies, institutions, and establishments) in positions filled by civil servants following the Law of Ukraine 

"On Civil Service", and in educational, medical, support and research institutions - in any positions and who

servicemen of the NGU discharged from military service due to age, health condition, and persons discharged from military service to the reserve or retired from the internal troops of the Ministry of Internal Affairs of Ukraine;

persons covered by the Law of Ukraine "On the Status of Veterans of Military Service, Veterans of Law Enforcement Agencies, Veterans of the National Police and Some Other Persons and Their Social Protection";

Laws of Ukraine , "On the Status of War Veterans, Guarantees of Their Social Protection", "On the Status and Social Protection of Citizens Affected by the Chernobyl Disaster", "On the Basic Principles of Social Protection of Labour Veterans and Other Elderly Citizens in Ukraine", provided they are under medical care in a healthcare institution of the Ministry of Internal Affairs, upon dismissal.

8) family members (spouse, children up to 18 years old, and in case of their studying in higher educational institutions - up to 23 years old):

police officers, former police officers, and former rank-and-file and senior officers of the Ministry of Internal Affairs dismissed from service for health reasons, due to age, due to staff reduction;

former police officers dismissed from service in the internal affairs bodies due to age, illness, or seniority;

servicemen of the National Guard of Ukraine (except for conscripts) and persons dismissed from the military service of the National Guard of Ukraine due to age, health condition, who have 20 years of service or more;

police officers, servicemen of the NGU who, following the legislation, are seconded (seconded) to the Verkhovna Rada of Ukraine, the Verkhovna Rada of the Autonomous Republic of Crimea, other state authorities (institutions, establishments) or local self-government bodies for the period of exercising their respective powers permanently with remaining in the police or military service;

civil servants and employees of educational institutions, medical and scientific institutions, and support institutions of the Ministry of Internal Affairs of Ukraine or the National Police from among former police officers who, as of the date of publication of the Law of Ukraine "On the National Police", served in the internal affairs bodies and had at least five years of calendar service and continued to work in the Ministry of Internal Affairs of Ukraine or the National Police (their territorial bodies, institutions, and establishments) in positions filled by state employees

police officers, rank-and-file and senior officers of internal affairs bodies who were killed (died) went missing, became disabled during their service in the police (including during participation in international peacekeeping operations), and were granted a pension based on the Law of Ukraine "On Pensions for Persons Discharged from Military Service and Some Other Persons";

servicemen of the NGU who were killed (died), went missing, became disabled during military service, or suffered in captivity during hostilities (war) or participation in international peacekeeping operations if these persons served in the NGU for at least 20 calendar years, and servicemen of the internal troops of the Ministry of Internal Affairs of Ukraine who were killed (died), went missing, became disabled during military service before the entry into force of the Law of Ukraine "On the National Guard of Ukraine".

2. Personnel support units of the apparatus of the Ministry of Internal Affairs, territorial bodies providing services of the Ministry of Internal Affairs, institutions, establishments, and enterprises belonging to the sphere of management of the Ministry of Internal Affairs; the main body of military management of the NGU, military management bodies of operational-territorial associations of the NGU, formations, military units (subdivisions), higher military educational institutions, military training units (centers), bases, healthcare institutions, and establishments; the central body of police management, territorial (including interregional) bodies of police

3. Each person attached for medical care shall be issued a pass to the MIA healthcare institution (Annex 2).

4. To obtain a pass to a healthcare institution of the Ministry of Internal Affairs:

1) persons referred to in subparagraphs 1 - 5 of paragraph 1 of this section, family members of police officers, servicemen of the National Guard of Ukraine (except for regular servicemen), civil servants and employees of educational institutions, medical and scientific institutions and support institutions of the Ministry of Internal Affairs of Ukraine or the National Police from among former police officers who, as of the day of publication of the Law of Ukraine "On the National Police", served in the internal affairs bodies and had at least five years of calendar service and continued to serve

2) persons referred to in:

paragraphs one - four of subparagraph 7 of paragraph 1 of this section, shall provide a copy of the pension certificate or an extract from the order of dismissal (or a copy of the employment record book) (with the original);

in the fifth paragraph of subparagraph 7 of paragraph 1 of this section, provide copies of the relevant veteran's certificate and a certificate from the place of work (service) before retirement or change of place of work (service) or an extract from the order of dismissal (or a copy of the employment record book) (with the originals);

subparagraphs seven and eight of subparagraph 8 of paragraph 1 of this section, shall provide copies of documents confirming their family ties (passport of a citizen of Ukraine, marriage certificate, birth certificate), copies of the certificate of a family member of the deceased, and pension certificate, according to which a pension is granted based on the Law of Ukraine "On Pension Provision for Persons Discharged from Military Service and Some Other Persons" (with the originals);

3) family members of former police officers and former rank-and-file and senior officers of internal affairs bodies dismissed from service for health reasons, age, due to staff reduction, former police officers dismissed from service in internal affairs bodies due to age, illness, or length of service, persons dismissed from military service of the NGU due to age, health reasons who have 20 years of service or more, citizens of Ukraine from among civil servants and employees of educational institutions, medical and scientific institutions and security institutions

4) children of persons who, following the legislation, have the right to medical care in health care institutions of the Ministry of Internal Affairs, in case of their studying in higher education institutions, shall provide an annual certificate issued by the higher education institution.

5. Civil servants, servicemen of the National Guard of Ukraine, police officers, and employees who are dismissed from service, military service, or position shall return the pass to the MIA healthcare institution to which it was issued.

Re-issuance of a pass to a healthcare institution of the Ministry of Internal Affairs shall be carried out when the status of a person changes after he/she submits copies of the documents specified in subparagraphs 2 - 4 of paragraph 4 of this section or the information specified in paragraph 2 of this section, which is provided by the personnel units according to the form given in Annex 1 to this Instruction.

6. Attachment for free medical service in healthcare institutions of the Ministry of Internal Affairs shall be carried out at the place of work, service (military service), and previous work, service (military service) of citizens of Ukraine and within the limits of expenditures provided for the maintenance of these institutions.

When persons referred to in subparagraphs 1 - 6 of paragraph 1 of this section are moved for temporary residence, work, or service to other regions of Ukraine for medical care in a healthcare institution of the Ministry of Internal Affairs of this region, copies of their service certificate (military ID) shall be provided.

When moving persons referred to in subparagraphs 7 and 8 of paragraph 1 of this section, for permanent residence or work in other regions of Ukraine for attachment for medical care to the health care institution of the Ministry of Internal Affairs of this region, copies of the pension certificate and copies of the documents referred to in the third paragraph of subparagraph 2 and subparagraph 3 of paragraph 4 of this section, and a document containing information on the place of registration (or actual place of residence) or certificates from the place of work (with the originals) shall be provided.

7. Medical support of persons specified in subparagraph 6 of paragraph 1 of this section is carried out by referrals of medical workers of the relevant educational institution.

8. The provision of medical assistance in healthcare establishments of the Ministry of Internal Affairs to servicemen in regular service of the NGU is carried out based on referrals and accompanied by the medical staff of formations, military units (subdivisions), higher military educational establishments, training military units (centers), bases, healthcare establishments, and institutions.

9. Citizens of Ukraine who are not included in the list of persons specified in this section, employees of institutions, establishments, and enterprises belonging to the sphere of management of the Ministry of Internal Affairs, the National Guard, the National Police, the State Migration Service and do not belong to budgetary institutions, establishments, and enterprises are served under contracts following the Resolution of the Cabinet of Ministers of Ukraine of September 17, 1996 No. 1138 "On Approval of the List of Paid Services Provided in State and Municipal Health Care Institutions and Higher Medical Educational Institutions".
